FicLand Terms Of Use

1. Agreement and Acceptance

FicLand (the “Platform”) is operated by FicLand Team. The Platform offers a creative environment in which developers may create, publish, share, and engage with interactive storytelling experiences.

By accessing or using the Platform, its mobile applications, or any related services, you (“User” or “you”) acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Use (“Terms”). Your continued use of the Platform will be considered acceptance of these Terms. If you do not agree with any provision, you must stop using the Platform immediately.

2. Account Registration and Control

2.1 Account Information

When creating an account, you must provide complete, accurate, and current information. You are responsible for promptly updating your account information whenever it changes.

2.2 Account Protection

You are responsible for maintaining the confidentiality and security of your login credentials. You must notify us immediately if you become aware of any unauthorized access to or use of your account. Unless otherwise required by law, you are responsible for all activities conducted through your account.

2.3 Account Suspension and Closure

We may suspend or terminate an account if we reasonably determine that the User has violated these Terms. Users may also delete their accounts through the available dashboard or account-management tools. By deleting an account, the User acknowledges that the associated loss of data may be permanent and irreversible.

3. User Qualification Requirements

3.1 Age Requirement

Users must be at least 13 years old to use the Platform. Where applicable laws establish a higher minimum age, including the age of 16 under GDPR in certain jurisdictions, the relevant local legal requirements will apply.

3.2 Legal Authority

If you access or use the Platform on behalf of a company, organization, or other legal entity, you represent and warrant that you have sufficient authority and legal capacity to bind that entity to these Terms.

3.3 Ineligible Users

You may not use the Platform if you have previously been suspended or permanently banned from the Platform, or if your use of the Platform would violate any applicable law or regulation.

4. Permission to Use the Platform

4.1 Authorized Use

Subject to your compliance with these Terms, we provide you with a limited, revocable, non-exclusive, and non-transferable license to access and use the Platform solely for creating, publishing, viewing, and interacting with literary works and storytelling content (“Stories”).

4.2 Usage Limitations

You may not reverse engineer, decompile, scrape, extract data from, or otherwise attempt to discover the source code or underlying structure of the Platform. You may also not use the Platform for unauthorized commercial activities.

4.3 Ownership of Platform Materials

All rights, titles, and interests relating to the Platform, including its software, technology, trademarks, branding, design, and Platform-provided content, remain the exclusive property of FicLand team or its applicable licensors.

5. Rules Governing Submitted Content

5.1 Ownership of User Materials

You retain ownership of the original literary works, comments, images, media, and other materials that you upload, submit, publish, or otherwise make available through the Platform (“User Content”).

5.2 Permissions Associated with User Content

License granted to FicLand: By submitting User Content, you grant FicLand a worldwide and royalty-free license to host, store, reproduce, adapt, display, distribute, and otherwise process the User Content as reasonably necessary to operate and provide the Platform.

Access granted to other Users: You authorize other Users to access, view, and interact with your User Content on a non-exclusive basis, subject to the features and functionality made available by the Platform.

5.3 Required Content Conditions

All User Content must:

(a) Be entirely original or used under a valid and lawful license;

(b) Comply with applicable laws, regulations, and third-party rights;

5.4 Content Review and Enforcement

We may review, restrict, disable, or remove User Content that violates these Terms or applicable community guidelines. Users who repeatedly violate the applicable rules may have their accounts terminated.

6. Unacceptable Platform Activities

When using the Platform, Users must not:

Bypass, interfere with, disable, or attempt to defeat any Platform security measure or access control;

Upload malware, malicious code, viruses, or any material intended to interrupt or damage the Platform or related services;

Impersonate another person or entity, misrepresent an affiliation, harass others, or engage in abusive conduct;

Use bots, scrapers, automated scripts, or other automated tools without obtaining our prior consent.

7. Charges, Subscriptions, and Taxes

7.1 Paid Services

Certain Platform features or services may require payment of subscription fees or other charges. Except where a refund is required by applicable law, all payments are non-refundable.

7.2 External Payment Providers

Payment transactions may be processed by PCI-compliant third-party service providers, including Stripe and PayPal. We are not responsible for processing failures, technical errors, or other issues caused by those payment providers.

7.3 Tax Obligations

Users are solely responsible for determining and paying any applicable VAT, GST, sales tax, or other tax arising from their purchases or use of paid services.

8. Restrictions on Legal Responsibility

8.1 Maximum Liability

To the maximum extent permitted by applicable law, the total liability of FicLand team for any claim connected with the Platform or these Terms will not exceed USD 500.

8.2 Types of Damages Excluded

FicLand team will not be responsible for any indirect, incidental, special, punitive, exemplary, or consequential damages arising from or relating to the use of, inability to use, or reliance on the Platform.

9. Service Warranty Exclusions

9.1 Platform Provided “As Is”

The Platform is made available on an “as-is” and “as-available” basis. To the fullest extent permitted by law, we disclaim warranties relating to merchantability, fitness for a particular purpose, accuracy, reliability, and non-infringement. We do not guarantee that the Platform will always operate without interruptions, delays, defects, or errors.

9.2 External Resources

The Platform may contain links to or integrations with websites, applications, products, or services operated by third parties. We do not control and are not responsible for the availability, content, security, practices, or performance of those external resources.

10. Your Obligation to Protect Us

You agree to defend, indemnify, and hold harmless FicLand team, including its applicable officers, employees, representatives, and affiliates, from and against any claims, liabilities, damages, losses, costs, or expenses arising from or related to:

Your User Content;

Your misuse of the Platform;

Your violation of these Terms.

11. Copyright and Ownership Complaints

11.1 Copyright Infringement Notices

FicLand complies with applicable DMCA procedures. Copyright owners or their authorized representatives may submit an infringement notice to contact@ficland.com.

A valid notice must contain:

Information identifying the copyright owner;

Identification and location of the allegedly infringing material;

A statement made under penalty of perjury confirming the accuracy and authorization of the notice.

11.2 Responses to Removal Requests

Users whose content is removed or restricted following a copyright complaint may submit a counter-notification through the same contact channel at contact@ficland.com.

12. Applicable Law and Claim Procedures

12.1 Controlling Law

These Terms and any dispute relating to them will be governed by the laws of [State/Country], without regard to its conflict-of-law rules or principles.

12.2 Mandatory Arbitration

Any claim, controversy, or dispute arising from or connected with the Platform or these Terms must be resolved through binding arbitration conducted under [JAMS/AAA Rules]. Arbitration proceedings will take place in [Jurisdiction].

To the extent permitted by law, all disputes must be brought on an individual basis, and the parties waive the right to participate in any class action, class arbitration, or representative proceeding.

We may modify or update these Terms from time to time. Where required, we will provide Users with prior notice of material changes. Continuing to access or use the Platform after the updated Terms become effective constitutes acceptance of the revised Terms.

13.2 Independent Validity of Provisions

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be limited or removed only to the extent necessary. All remaining provisions will continue to remain valid and enforceable.
